Real Housewives of Salt Lake City star Mary Cosby’s son Robert Cosby Jr.’s wife has filed for divorce weeks after his latest arrest for allegedly violating a restraining order. Robert Jr.’s wife, Alexiana Arian Smokoff, filed for divorce in Salt Lake County District Court in Salt Lake City on Monday, Nov. 24. The petition for divorce requires that both parties do not “harass, intimidate or disturb the peace of the other party, by any means, including electronically.” The documents reviewed by PEOPLE continue to list prohibited actions on behalf of either party: “commit domestic violence or abuse against the other party or a child, use the other party’s name, likeness, image, or identification to get credit, open an account for service, or obtain a service, cancel or interfere with telephone, utility, or other services used by the other party, cancel, modify, terminate, change the beneficiary.” The petition also prohibits either party from terminating any “policy of health insurance, homeowner’s or renter’s insurance, automobile insurance, or life insurance.” The filing comes shortly after Robert Jr. was arrested on Nov. 9 and charged with violating a pretrial protective order, a Class A misdemeanor in Utah. The same day, he was also charged with property damage/destruction loss, assault on peace officer or military SVC member in uniform, fail to stop at command of law enforcement, interfering with a peace officer, and criminal trespassing, according to the arrest record reviewed by PEOPLE. He was booked and remains incarcerated in the Salt Lake County Jail, PEOPLE can confirm. “Today Robert Cosby took responsibility for the mistakes he has made and the pain he has caused his ex-wife and her family,” his lawyer tells PEOPLE in an exclusive statement of Cosby, who had a hearing scheduled for Tuesday, Nov. 25. “Robert was slow to recognize that his marriage was over. He continued to make contact with his ex-wife in an effort to reconcile. He now realizes that the relationship is over and he must move on.” Robert Jr. was previously arrested on Sept. 6, when police responded to an initial domestic violence report. He was accused of attempting to climb through a dog door to break into his father-in-law’s home before he allegedly assaulted someone on the front lawn. When police ordered him to get on the ground, Robert Jr. allegedly failed to do so. He ultimately complied before he was arrested. He was previously charged with criminal trespassing, assault, failure to stop at the command of law enforcement and three counts of violating a court order, per his booking record viewed by PEOPLE. He’s never encountered anything like that. He’s never been through anything like that. I don’t mind it. It hurt me at the time. I was devastated, I was worried, I was scared. But some things happen for a reason to show you the path you’re on. I feel like he needed that and that he understands that that’s the wrong journey.” Robert Jr. previously told PEOPLE that he’s taking his journey “day by day” and that he’s “not where I want to be, but I’m certainly not where I used to be.” He added, “I will get there!” PEOPLE has reached out to attorneys for Smokoff.
