Amazon Technologies, a subsidiary of global e-commerce giant Amazon, has secured significant relief from the Supreme Court in a long-standing trademark infringement dispute.

### Background of the Case

The conflict involves Lifestyle Equities C.V., owner of the Beverly Hills Polo Club (BHPC) brand, which sued Amazon Technologies in 2020 for allegedly infringing on its trademark. Lifestyle and its licensee claimed exclusive rights to the BHPC logo and alleged that identical or deceptively similar marks appeared on apparel sold under Amazon’s in-house Symbol brand, as well as by Cloudtail India, a major seller on Amazon.in.

Proceedings advanced without Amazon’s participation after the court went ex parte in April 2022. In February 2025, a single-judge bench ruled against Amazon Technologies, ordering damages of approximately ₹336 crore for lost royalties and promotional expenses, along with ₹3.23 crore in costs. Additionally, the court permanently restrained Amazon and its affiliates from using the BHPC logo or any similar marks.

### Supreme Court’s Observations

Amazon challenged the decree before the Delhi High Court’s division bench, which stayed the execution of the order in July 2025, citing procedural irregularities and legal defects without requiring Amazon to deposit the awarded amount.

The Supreme Court upheld the division bench’s stay and identified serious procedural flaws in the earlier ruling. It emphasized that Amazon Technologies was not properly served notice, which led to the case proceeding without giving the company a fair opportunity to defend itself.

Moreover, the apex court criticized the single judge for treating Amazon and its related entities as one for the purpose of liability, although Amazon Technologies was not directly involved in the alleged infringement. The bench remarked, *“Even if it were to be presumed, merely for the sake of argument, that Amazon Technologies took a conscious decision not to participate in the suit proceedings, that cannot justify mulcting it with damages of ₹336 crore.”*

### Current Status and Next Steps

With the Supreme Court’s intervention, Amazon Technologies has been granted significant relief from the hefty damages imposed. The case highlights the importance of proper procedural conduct and fair notice in legal proceedings.
